These Terms and Conditions (“Terms“) govern the use of the PLX mobile application (hereafter, the “App“) and its associated services. By downloading, installing, or using the App, you (“User” or “you“) fully accept these Terms and the Privacy Policy. If you do not agree with any part of the Terms, please refrain from using the App.
1. Identity of the owner and purpose of the App
The App is developed and managed by Fuxion, with contact email sistemas@fuxion.net (hereafter, “PLX”). Its purpose is to provide a healthy‑activity management tool. Access to the App is voluntary and free for Fuxion users or customers; however, certain features may require an additional subscription.
2. Acceptance of the Terms
By downloading or using the App, the User assumes the status of user and is bound by these Terms and the Privacy Policy. This agreement constitutes a binding contract between PLX and the User. Downloading and using the App confers user status and entails acceptance of all conditions contained in this document.
Users are advised to read these conditions each time they use the App, as they may be modified subsequently.
3. Registration and age requirements
Some features may require the creation of an account. The User undertakes to provide truthful, complete and up‑to‑date information. To use the App, you must be at least 18 years old. We do not allow registration or use of the App by persons under 18 years of age, even with parental or guardian authorisation. The User is responsible for maintaining the confidentiality of their credentials and for all activities undertaken from their account. PLX is not responsible for unauthorised use of accounts.
4. Charges and connectivity
The User is responsible for costs associated with downloading and using the App, including charges from their mobile operator or roaming fees. Please check with your service provider for applicable charges.
5. Proper use and prohibited activities
The User agrees to use the App in accordance with the law, these Terms and acceptable‑use guidelines. It is prohibited to:
- Alter or modify the App, circumvent or tamper with its security features, or use it for commercial or advertising purposes without authorisation.
- Use the App for illegal activities or those that harm the property, rights, or interests of PLX or third parties.
- Reproduce, copy, distribute, publicly communicate, or modify the App or its contents without authorisation.
- Collect data from other users, send spam, harass, distribute offensive content, or infringe intellectual property rights. These guidelines form part of the acceptable use policy that all users must abide by.
PLX reserves the right to suspend or cancel a User’s account if they breach these prohibitions or make abusive use of the App.
Prohibited activities also include attempting to decompile or reverse engineer the software, interfering with the normal operation of the service, or using the App to harm networks or servers.
6. Intellectual property and licence of use
All content in the App (texts, images, graphics, logos, trademarks and software) is the property of PLX or authorised third parties. The User acquires no rights over them through use of the App.
A non‑exclusive, free, worldwide licence is granted to the User to use the App personally and non‑transferably. This licence also covers updates and improvements and may be unilaterally revoked at any time.
Users who generate their own content through the App (e.g., comments, images, or documents) declare that they hold the necessary rights and grant PLX a free, non‑exclusive, worldwide licence to use, reproduce, distribute and display such content in order to provide the service. PLX acquires ownership of content generated by users.
7. Personal data and privacy
PLX protects the privacy of its users and collects only the data strictly necessary to provide the service. The App may track activity and use analytics services anonymously.
Detailed information on the collection, use and protection of personal data is available in the Privacy Policy, which forms an integral part of these Terms. Users should consult the Privacy Policy to understand what information is collected and the measures taken to protect it.
8. Updates, modifications and termination
PLX may update the App to improve features, correct errors or comply with legal requirements. Likewise, PLX may modify these Terms at any time. Modifications will be published in the App or on the website and will take effect upon publication. Continued use of the App after the Terms are modified constitutes acceptance of the changes.
If you do not accept the new Terms, you must stop using the App.
PLX may terminate or suspend the User’s access to the App without prior notice in case of breach of the Terms or when deemed appropriate for operational or security reasons.
The User may cancel their account at any time through the App’s options or by contacting PLX.
9. Liability and disclaimer
PLX does not guarantee that the App is error‑free or that access will be uninterrupted. The User is responsible for having appropriate tools to detect and disinfect malicious software.
PLX shall not be liable for any damages or losses that may arise from use of the App, including interruptions, data loss or connectivity failures. To the extent permitted by law, PLX excludes any implied warranties regarding the App and limits its liability to the maximum extent legally allowed.
10. Indemnity
The User agrees to indemnify and hold harmless PLX, its directors, employees and collaborators from claims, liabilities, damages, losses and expenses arising from breach of these Terms, improper use of the App, or violation of any law or third‑party right.
11. Governing law and jurisdiction
For the resolution of any disputes relating to the interpretation or application of these Terms, the parties submit to the courts of the city where PLX’s registered office is located, unless applicable law establishes another jurisdiction.
